TO ALL LOCAL UNIONS

Fraternal Greetings:

Pursuant to article IV of the constitution you are hereby notified a Special Convention of the Delaware State AFL-CIO will be held at the UAW Local 1183 Hall, 698 Old Baltimore Pike, Newark, Delaware. The Convention will convene at 8:00 A.M. on Saturday, August 2, 2014.

Your Local Union # __________ is entitled to ______delegate (s) and ______ alternate (s) to the convention, based on the average membership on which you have paid per capita tax during the preceding 12 months.

REGISTRATION

Registration and check-in will begin at 7:00 A.M. The registration fee will be $75.00 for each delegate and each alternate attending the convention and shall be forwarded to the Secretary-Treasurer.

ARTICLE IV

CONVENTION

SECTION 1. The Convention shall be the supreme governing body of this Council, subject, however, to the Constitution of the American Federation of Labor and Congress of Industrial Organizations.

SECTION 3. A special convention may be called by direction of the Executive Board.

(a) Representation to special conventions shall be on the same basis and subject to the same qualifications and procedures as regular conventions.

(b) A special convention shall be clothed with like authority and shall be governed by the same procedure as regular conventions; however, such special convention shall be limited solely to the subject or subjects specifically and definitely indicated in the call for special convention.

(c) Special conventions may be called by direction of a regular convention, by order of the General Board, or upon written request of affiliates representing a majority of members on whom per capita is paid.

SECTION 4. The President shall preside at all regular and special conventions and shall appoint such convention assistants needed to facilitate the work of the convention.

(a) The President shall appoint a Committee on Credentials composed of five (5) delegates which shall, with the Secretary-Treasurer, meet within three (3) days after the credentials of the delegates-elect must be in the office of the Secretary-Treasurer, as required by Article IV, Section 7, and shall examine the credentials of the delegates-elect and submit their report at the opening of the convention.

(b) The convention shall not be constituted for business until after the Credentials Committee shall have reported on credentials of all delegates present at the scheduled time on the opening date of the convention.

(c) The President shall appoint, in addition to the officers of the convention and the Credentials Committee, such committees as are necessary to conduct the affairs of the convention. Appointments shall be made in consultation with the Executive Board. Such committees may meet prior to the opening date of the convention to consider resolutions, appeals, reports and constitutional amendments submitted to the convention, and shall report thereon to the convention.

SECTION 5. The Secretary-Treasurer shall have charge of all information, protests, etc., relating to the seating of delegates.

SECTION 6. No delegate shall be seated unless the organization to which he belongs is affiliated with the Delaware State AFL-CIO.

(a) No affiliate shall be represented by proxy, and no delegate shall represent more than one (1) affiliate.

SECTION 7. All credentials of delegates-elect must be in the office of the Secretary-Treasurer at least ten (10) days prior to the convening of the convention. Credentials received after that time shall be considered irregular by the Credentials Committee and shall require a two-thirds (2/3) vote of the convention to seat such delegates.

SECTION 8. The Registration fee, set by the Executive Committee, shall be paid with each delegate and each alternate credential. Said monies to be used to defray the expenses of the Convention.

SECTION 9. The Executive officers of this Council who are not elected as delegates shall be ex-officio delegates to the convention with all rights and privileges of elected delegates, but without vote.

SECTION 10. One-fourth (1/4) of the delegates seated at any convention shall constitute a quorum for the transaction of business.

SECTION 11. Questions may be decided by voice vote or show of hands, but a call of the roll may be demanded by thirty per cent (30%) of the delegates present.

SECTION 12. The rules and order of business governing the preceding convention shall be enforced from the opening of any convention of the Council until new rules have been adopted by action of the convention.

SECTION 13. Resolutions, petitions, memorials, appeals, or amendments to this constitution to be considered by any convention of the Council must be signed by duly authorized delegates or the Secretary of an affiliated union, and submitted in triplicate (3 copies), and be received by the Secretary-Treasurer not less than fifteen (15) days prior to the opening of the convention.

(a) The Secretary-Treasurer shall cause to be printed and distributed to the delegates such documents that comply with this Section after the President has classified and referred same to the appropriate convention committee.

(b) Any of the above mentioned documents not complying with the provisions of Article IV, Section 13 and 13(a) shall require unanimous consent before presentation to the convention, provided, however, that the Executive Board may present resolutions at any time during the convention without requiring unanimous consent.

SECTION 14. Each morning session of the convention shall be opened with a prayer and the pledge to the flag of the United States of America.

ARTICLE V

REPRESENTATION

SECTION 1. Each regularly affiliated organization shall be entitled to representation in convention as follows:

(a) Local unions shall be entitled to one delegate for the first one hundred (100) members or fraction thereof, and an additional delegate for each additional one hundred (100) members or major fraction thereof.

(b) Local or State-wide councils; two (2) delegates (1 per capita vote each).

(c) A state chapter, or local chapter if no state chapter exists, of an AFL-CIO constituency group shall be entitled to one (1) delegate and one (1) vote.

(d) Affiliated locals in good standing shall be entitled to representatives and votes in the conventions of the Council based upon the average per capita tax paid for the 12 months’ period ending 60 days immediately preceding the convention. The average per capita membership for local unions affiliated for less than the 12 months’ period shall be computed from the month of the most recent affiliation and shall be determined by dividing the total per capita tax for all months of the most recent affiliation by 12.

(e) The votes of a local union shall be divided equally among all its accredited delegates present and each delegate shall be entitled to cast only his assigned number of votes, except that to facilitate the calling of the roll, one delegate may be designated to cast all of the votes of the delegates representing his/her local union, provided that if any delegate shall challenge the correctness of the votes so cast the individual delegates of that local union shall be polled.

SECTION 2. Except on roll call votes, each delegate shall be entitled to one vote. Voting shall be by voice vote or division of the house (show of hands or standing vote) unless a roll call vote is properly demanded by 30% of the delegates present. On roll call vote each local shall be entitled to a number of votes equal to its average membership as determined under provisions of Section 1 c of this Article.

Notice To All Union Secretaries:

Enclosed is a blank credential. Please choose delegates as soon as possible. When delegates are chosen, make certain all credentials are completed in full and return the original copy to the State Council Office, retaining a copy for the attending delegate to present at time of registration. For assignment of committees and work on resolutions, promptness is very important.
